The Equality Act 2010 (the ‘Act’) protects individuals and prohibits discrimination because of a disability. Disability discrimination is outlawed at work (including job applications) and in relation to the way goods and services are provided to consumers.

There are 6 kinds of unlawful discrimination under the Act (direct and indirect disability discrimination, discrimination arising from disability, victimisation and harassment).

• Direct disability discrimination ­ this occurs when a person is treated less favourably because of their disability. In order to bring a claim of direct disability discrimination, an employee must show:

- That s/he has been treated less favourably because of disability

- That s/he was subject to disadvantage or detriment as a result of that treatment.

• Indirect disability discrimination ­ this occurs where an arrangement or feature relating to the employment (technically known as a provision, criterion or practice (PCP)) is applied or would be applied equally to all employees, but puts people of a particular disability at a particular disadvantage when compared with people without that disability and puts the complainant at that disadvantage; and is not a proportionate
• Discrimination arising from a disability - A disabled person has a right not to be treated unfavourably because of something arising in consequence of their disability. If they are treated unfavourably, then the employer must objectively justify that treatment.
• Duty to make reasonable adjustments ­ the duty arises where a provision, criterion or practice (PCP) or physical feature puts a disabled person at a disadvantage compared to a non-disabled person, the employer must make reasonable adjustments to eliminate the disadvantage.
• Harassment - Harassment related to disability is a form of discrimination. It is defined as unwanted conduct related to disability that has the purpose or effect of violating a person’s dignity or of creating an intimidating, hostile, degrading, humiliating or offensive working environment for the disabled person.
