We do not act for individuals in relation to NMW matters.
We do act for employers whether in relation to their own auditing process/es or to advise on HMRC investigations/enforcement. There have recently been a number of high profile actions against larger employers involving both “naming and shaming” and large fines. We are able to advise on the legal aspects of the investigation and also limiting the reputational risk.
Recent Instructions include:
- Advising an established client in relation to an NMW investigation by HMRC and meeting with HMRC to present the client’s position.
- Advising a large client on the NMW ramifications of accommodation provided to a number of its workers and the detailed application of the rules of “on call” time.
- Advising a client on the status of voluntary workers and individuals on work placements and the NMW considerations.
