Literally "from kindness", ex-gratia is used to describe something done without any legal obligation. In the employment law context, ex-gratia is most often used in compromise agreements to describe a non-contractual payment made by the employer on termination of employment, the first £30,000 of which is usually tax-free.
Moral obligation or early settlement are usually the reasons for an ex-gratia payment and when making an ex-gratia payment the payer admits no legal liability. Ex-gratia payments are often offered in the case of redundancies.
