Gareth Kervin, Partner at Kervin & Barnes, negotiated terms in excess of £1,500,000 for a Finance Director departing a London Hedge Fund. The settlement involved payment of future losses, payment of deferred equity and the provision of “good leaver” status.  The case involved FSA regulatory issues and complex loans and options under an EMI scheme.  Gareth commented “The headline cash compensation of a settlement is often only the surface, the advantage of negotiating “good leaver” status is that it often results in a considerable extra cash value, has tax benefits and is often less “valuable” to the employing company than making an equivalent cash payment.

Kervin & Barnes are delighted to have been invited by the local Chartered Institute of Personnel and Development (CIPD) branch to speak at this year’s conference on the Equality Act 2010.

Jahad Rahman, Senior Associate will provide an overview of the Equality Act and explore how it is working in practice. He will also look at recent developments and provide tips on how to effectively manage discrimination claims.

Jahad Rahman of Kervin & Barnes acted for a director of a large financial services company who brought a complex claim for disability discrimination and unfair dismissal. She claimed that she was unfairly selected for redundancy and because she was suffering from a disability.  Jahad represented his client at a preliminary hearing at the London Central Employment Tribunal. The matter was eventually settled on a confidential basis for a package in excess of £750,000.  Jahad worked in conjunction with Simon Devonshire QC of 11 Kings Bench Walk on the terms of settlement.
