In good time, fair and genuine
The first requirement of a fair redundancy procedure is that warning of an impending redundancy is given as soon as possible. This will allow the employee the maximum time to prepare for the potential change, but also allow them the fullest opportunity to influence the redundancy process.
The redundancy process is a “consultation” and whilst Employment Tribunals will be reluctant to scrutinise the employer’s decisions on how to run its business, there is a requirement for any redundancy process to be fair and genuine. The process is not simply a matter of “notification”, there is a requirement for genuine consultation.
