TUPE Transfers

We have significant experience of advising employees on the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE). In particular, we have a track record of providing high quality advice to employees on their employment rights before and/or after the transfer of a business and when a ‘service provision change’ takes place (for example, where a contractor takes on a contract to provide a service for a client from another contractor).

We also advise on collective employment law issues and have successfully pursued claims in the Tribunal for failure to inform and consult appropriate representatives.

Recent experience includes:

• Successfully settled a group action in the Tribunal for unfair dismissal and breach of TUPE. In breach of TUPE, the employer attempted to unilaterally vary employees’ terms and conditions of employment shortly after the transfer. The claim settled for just under £1,000,000;
• Advising a senior executive following the acquisition of a business and the use of share transfers to avoid TUPE; and
• Successfully negotiated a substantial settlement for a group of employees where the employer failed to inform and consult appropriate representatives.
