Inadvertent breach of WTR?8 March 2016
If your company’s holiday year runs from 1 April to 31 March then you might inadvertently breach the Working Time Regulations unless you take action.
This is owing to the fall of Easter this year. The 1 April 2015 to 31 March 2016 holiday year contains 10 public/Bank holidays, but the 1 April 2016 to 31 March 2017 holiday year contains only 6 public/Bank holidays. Therefore, if your employees receive an entitlement of “20 working days plus public/Bank holidays” there will be a shortfall in 2016/17. As a reminder, the statutory minimum holiday entitlement is 5.6 weeks or 28 days, so you would need to give employees on those contracts 2 ‘bonus’ days for 2016/17.
